Full Terms and Conditions
1.1. The Organizer of the “7th Birthday Competition!” (hereinafter referred to as “Competition”) is OKPAY Inc.
1.2. The Competition is not a lottery, or a gambling venture, or any other risk-based game, due to the fact that the prize fund of the Competition will not be distributed in a random drawing. Participation is free of charge.
1.3. The prize fund is formed at the expense of the Organizer, namely OKPAY Inc. Trust Company Complex, Ajeltake Road, Ajeltake Island, MH96960 Majuro, Marshall Islands.
1.4. All Participants in all countries and territories without regional or geo-restrictions can take part in the Competition.
1.5. The Competition will commence March 8, 2017 at 00:00 GMT, and conclude April 8, 2017 at 23:59 GMT (hereinafter referred to as “Competition period”).
§2. Competition Participants
2.1. All capable natural persons regardless of their nationality or residence are allowed to participate in the Competition (hereinafter referred to as “Participants”).
2.2. All legal persons, as well as natural persons that are affiliated with or represent the Organizer, or members of the Organizer’s staff, or family members of such persons, as well as staff members or representatives of any other legal or natural persons or family members of such persons that are directly involved in the process of organizing and holding of the Competition are not allowed to participate in the Competition.
§3. Terms and Conditions
3.1. Participants can earn points in the classic arcade game available at https://www.okpay.com/promo/7th-birthday/.
3.2. The maximum number of attempts is unlimited. However, in order for a Participant’s score to be shown on the scoreboard of the Competition, the Participant must specify their e-mail address and nickname, and share a post about their participation in the Competition to their social media profile (vk.com, facebook.com, twitter.com).
3.3. In order to claim a prize, a Participant must create and verify their personal account in the OKPAY payment system (www.OKPAY.com) if they do not already have one.
3.4. The total prize pool – $800 (eight hundred US dollars) and 1 (one) Apple iPhone 7 32Gb.
3.5. The Participant with the highest score will receive the Apple iPhone 7 32Gb, the Participant with the second highest score – $300, the Participant with the third highest score – $150, the Participants with the fourth to the tenth highest scores – $50.
§4. Conditions of participation in the Competition
4.1. Each Participant of the Competition solemnly agrees to comply with the Rules of the Competition and recognize the Organizer’s right to unilaterally and without prior notice make changes to the Rules of the Competition by publishing a different set of Rules, and the Organizer’s right to unilaterally and without prior notice to Participants suspend the Competition at any moment.
4.2. The Organizer is not obliged to personally inform Participants about changes in the Rules.
§5. The format of the Competition
5.1. In order to become eligible to receive a prize, a Participant must perform the activities described in paragraphs 3.1. and 3.2. of the Rules. One Participant can receive only one prize.
5.2. One Participant can register and verify only one personal OKPAY account.
§6. The Winner selection process
6.1. Ten Participants with the top 10 scores in the game according to p. 3.1. will be proclaimed the Winners. Such Participants will receive the prizes mentioned in p. 3.5 of the present Rules.
6.2. The Organizer reserves the right to disqualify one or more Winners of the Competition if it becomes known to the Organizer that the Winner(s) submitted inaccurate information, or if the Organizer detects attempts to meddle with scores or other violations of the Rules of the Competition. In such a case, the disqualified Participant loses the right to receive a prize. The Organizer also reserves the right not to engage in talks with any disqualified Participant.
§7. Prize delivery
7.1. The prizes in the form of money transfers will be delivered to Participants’ registered and verified OKPAY personal accounts within 10 (ten) days since the moment of the conclusion of the Competition. The Apple iPhone 7 will be sent to the verified home address of the Winner of the Competition.
7.2. The Winners of the Competition pledge to publish appropriate information about the prizes they will have received: share a post on social media (vk.com, facebook.com, twitter.com) with screenshots showing incoming money transfers to their personal accounts (a photo with the iPhone 7, while hand-holding a paper sheet with the name of the Competition, date and OKPAY account number written on it).
§8. Additional Conditions
8.1. The Organizer of the Competition is not liable for any loss or damage (direct or indirect), as well as physical damage incurred due to the conduct of the Competition and the reception of the prize by the Winner.
8.2. The Organizer is not liable for inconsistencies or errors concerning the information available on the Internet, and for the reliability of the software or equipment involved in the conduct of the Competition, as well as for any technical error or errors that may emerge at some point of the conduct of the Competition including missing and deleted information, disconnects, delays in software performance or data transfer, landline, mobile, satellite and other types of communication breakage, data transfer network overload or high load on the web-site server, software malfunction, unauthorized attempts to access OKPAY personal accounts, and damage to mobile devices of Participants or any other persons incurred as a result of their participation in the Competition or download of information about the Competition from the Internet.
8.3. If, for some reason, the Competition cannot be carried out according to the plan due to technical problems, unauthorized meddling, fraudulent activity, or any other reason beyond the Organizer’s power, that can affect the results of administering, security, fairness and the established course of the conduct of the Competition, the Organizer reserves the right to disqualify anyone who attempts to influence the outcome of the Competition, as well as cancel or suspend the Competition, or make changes to the Conditions of the Competition.
8.4. In force majeure cases, including war and terrorist attacks, the Organizer reserves the right to cancel the Competition or make changes to the way the Competition is conducted.
8.5. The Participants of the Competition pledge to comply with copyright protection rules on images, logos, trademarks and information. The Organizer is not liable for any types of copyright infringements and intellectual property rights violations perpetrated by the Participants of the Competition.
8.6. The Competition is regulated by the law of the the Republic of the Marshall Islands. All disputes which arise due to the conduct of the Competition are settled through negotiations. Disputes that cannot be settled through negotiations will be submitted to the appropriate district court of the Organizer.
